Terms and Conditions.

1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The promoter is Majans Pty Ltd (ABN 55 010 469 235) of 11 Bronze Street, Sumner, QLD Australia. (“Promoter”).
3. Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, Participating Stores (as defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Entries into the promotion open at 8:00AM AEST on 10^th of January 2022 and close at 11:59PM AEST on 28^th of February 2022 (“Promotional Period”).
5. To enter (“Eligible Entrant”), individuals must complete the following steps during the Promotional Period:
   1. Purchase any Bhuja product (“Eligible Product”) from a Participating Store during the Promotional Period (“Qualifying Transaction”). In the event a purchase receipt is not automatically provided by a staff member, it is the individual’s responsibility to request one; and
   2. Where featured scan the QR code located on the front of Eligible Product using a mobile device to launch the promotional website, or visit www.bhuja.com.au/mix-it-up-this-summer-competition, input the requested details (including full name, date of birth, email address, contact number and state/territory of residence) and submit the fully completed entry form.
6. A participating store is any retail store in Australia that stocks the Eligible Product (“Participating Store”)
7. Multiple entries permitted, subject to the following: (a) only One (1) entry is permitted per Eligible Product purchased; (b) each entry must be submitted separately and in accordance with these Terms and Conditions.
8. Entrants must retain a copy of their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the Participating Store of purchase, that an Eligible Product was purchased, and that the purchase was made during the Promotional Period.
9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
10. There are Three (3) Prize Packs to be won. Each Prize Pack is valued up to AUD$1,585 and includes:
    1. 1 x Bhuja Surfboard
    2. 1 x leg rope
    3. 1 x surfboard cover
    4. 1 x 3 Fin Set
    5. 100 x Bhuja core range products
11. A limit of One (1) Prize Pack permitted per person.
12. There will be Three (3) Prize Draws, details as follows:
    1. Prize Draw 1: Prize Draw 1 will take place at 2:00pm AEST on 1^st of March 2022, at Majans, 11 Bronze Street, Sumner, QLD, Australia. The first (valid) entry drawn in Prize Draw 1 will be awarded One (1) Prize Pack as listed above.
    2. Prize Draw 2: Prize Draw 2 will take place at 2:30pm AEST on 1^st of March 2022, at Majans, 11 Bronze Street, Sumner, QLD, Australia. The first (valid) entry drawn in Prize Draw 2 will be awarded One (1) Prize Pack as listed above. The non-winning entries of Prize Draw 1 will be added to the Prize Draw 2 pool of entry.
    3. Prize Draw 3: Prize Draw 3 will take place at 3:00pm AEST on 1^st of March 2022, at Majans, 11 Bronze Street, Sumner, QLD, Australia. The first (valid) entry drawn in Prize Draw 3 will be awarded One (1) Prize Pack as listed above. The non-winning entries of Prize Draw 2 will be added to the Prize Draw 3 pool of entry.
13. The total prize pool value is $4,755.
14. Any ancillary costs associated with the Prize Pack are not included.
15. Each prize winner will be notified via email within Three (3) days of each draw. Each winner’s name will be published at bhuja.com.au/mix-it-up-this-summer-competition within Three (3) days of each draw.
16. The winners will receive an email by 4^th of March 2022 to confirm details of prize and confirm delivery address. Upon the winner claiming their prize, we will provide all relevant information regarding their prize. If the winner is not able to participate in or accept any part of the prize, the prize will be forfeited.
17. The Promoter may elect in its absolute discretion to deliver the prize to the winner by post or courier to the prize winner’s address or closest depot for collection. However, no responsibility will be accepted by the Promoter for the safe and effective delivery of the prize. The winner accepts all risk in relation to the safe and timely delivery of the prize. All prizes must be collected within 30 days. At all times, it is the sole responsibility of the winner to collect his or her prize.
18. Subject to acceptance by the Promoter in its absolute discretion, a winner may nominate a designated representative to collect a prize. The representative will be required to present written authorisation from the winner and produce photo identification which demonstrates to the satisfaction of the Promoter that he or she is the winner’s representative.
19. In the event that a winner fails to collect a prize within the prescribed time limit or chooses not to accept a prize, that person irrevocably relinquishes all right, title or interest in the prize. All claims to that prize will be dealt with by the Promoter in its absolute discretion.
20. Eligible Entrants that have won a Prize Pack will be deemed a winner and will be subject to verification at the end of the Promotional Period.
21. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
22. The Promoter’s decision is final and no correspondence will be entered into.
23. Incomplete or illegible entries will be deemed invalid.
24. Subject to the unclaimed prize draw, if for any reason a winner does not take/redeem a prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or an element of the prize) will be forfeited.
25. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
26. If a winning entry is deemed invalid, or if a prize is not accepted or claimed within Seven (7) days of the Prize Draw, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws at 2:30pm AEST on 8th of March 2022 at the same location as the original draws as necessary to distribute the prizes, subject to any written directions given by any relevant authority. Any winners in this draw will be notified in writing within Three (3) days of the re-draw and any winners from the re-draw will have their name published at bhuja.com.au/mix-it-up-this-summer-competition on 8th of March 2022. If there are any unclaimed prizes, each unclaimed prize will be distributed to the next valid entry randomly drawn in descending order of value until all unclaimed prizes are awarded. Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
27. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
28. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used.
29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention, fraud or pandemic, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
30. Printing and other quality control errors will not invalidate an otherwise valid prize claim. Promotional materials are void if stolen, forged, mutilated or tampered with in any way.
31. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
32. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a entrant; or (f) taking/use of a prize.
33. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed below. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia. 34. Each entrant acknowledges that this promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or instagram. In participating in this promotion entrants are providing information to the Promoter and not to Facebook or instagram. To the extent permitted by law, each entrant releases Facebook from any and all liability in relation to this promotion.
